Filed in 2017, the suit alleged SimonMed misclassified field service engineers as exempt and denied them overtime under the Fair Labor Standards Act.
Outcome
In a June 2020 order the court found the “learned professional” exemption did not apply — i.e., the workers were misclassified — and set overtime accordingly. Remaining issues, including liquidated damages and a retaliation claim, proceeded from there.
